Development Appeal Board Meeting

Thursday, April 19

The Development Appeal Board will meet on April 19, 2018 at 9 a.m.

Take notice that the Development Appeal Board (DAB) will hold a hearing on Thursday, April 19, 2018 at 9 a.m. in the Town Hall Council Chamber located at 110 Bear Street, Banff, AB to hear the following appeals:

Appeal #02-18
An appeal by the applicant against a decision of the Municipal Planning Commission to refuse the renewal of Development Permit 14DP46 for the continued operation of a bed and breakfast home at 213 Otter Street on grounds of:
  • (a) Non-compliance with the requirements of Section 10.3.2(l) of the Land Use Bylaw which states that no person shall operate or permit to operate more commercial accommodation units in a bed and breakfast establishment or guest home than have been authorized by the development approving authority and are shown on the valid licence issued for the establishment; and 
  • (b) Non-compliance with the requirements of Section 10.3.2(e) of the Land Use Bylaw which states that a bed and breakfast home shall be operated exclusively by a live-in owner as an accessory use and shall not change the principal residential character, use or external appearance of the dwelling.

Appeal #03-18
An appeal by the applicant against a decision of the Municipal Planning Commission to refuse the renewal of Development Permit 03DP16 for the continued operation of a bed and breakfast home at 138 Otter Street on grounds of:
  • (a) Non-compliance with the requirements of Section 10.3.2(l) of the Land Use Bylaw which states that no person shall operate or permit to operate more commercial accommodation units in a bed and breakfast establishment or guest home than have been authorized by the development approving authority and are shown on the valid licence issued for the establishment; and
  • (b) Non-compliance with the requirements of Section 10.3.2(e) of the Land Use Bylaw which states that a bed and breakfast home shall be operated exclusively by a live-in owner as an accessory use and shall not change the principal residential character, use or external appearance of the dwelling.

Verbal presentations and written submissions to the Development Appeal Board may be made at the scheduled hearing. Written submissions to be included in the information packet provided to the DAB members prior to the hearing must be received by no later than 4 p.m. on Thursday, April 12, 2018. Written submissions should be forwarded to the Secretary, Development Appeal Board, Town of Banff, P.O. Box 1260, Banff AB T1L 1A1.
