A public hearing on Bylaws 346 and 347 has been scheduled for Monday, April 13 at 2 p.m. at Banff Town Hall.
Bylaw 346 (Land Use Bylaw Amendment – Existing Commercial Gross Floor Area Transferability)
Bylaw 346 proposed to permit the transfer of existing commercial floor area from one site to another. The current Land Use Bylaw does not permit existing floor area to be transferred but does allow it to be reconstructed on-site after demolition. Bylaw 346 would permit existing floor area to be transferred from a “donating” property to a “receiving” property under specific conditions. This approach is intended to anticipate commercial build-out when all existing CDAs have been constructed. The bylaw proposes restrictions on donating properties to ensure that these spaces do not return to commercial use in the future.
Bylaw 347 (Land Use Bylaw Amendment – Existing GFA Transfer Fees)
Bylaw 347 proposes amendments to the Development Fee schedule in the Town of Banff’s Land Use Bylaw. The 2015 Town of Banff Financial Plan states that fees for development related functions will be set at levels for full cost recovery.
Public hearings are open to all members of the public and provide an opportunity to speak to council on proposed bylaws.
